1. Introduction

Welcome to the “Energy Score” quiz (the “Quiz”) offered by Active30 (“we", “us", “our”). By participating in the Quiz and/or booking a call through our website: https://goactive30.com/energy-score (the “Site”), you agree to these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, please do not take the following Quiz.

2. Eligibility

You represent and warrant that you are at least 18 years old and legally capable of entering into binding agreements. If you are accessing the Site or Quiz on behalf of an entity, you represent you have the authority to bind that entity to these Terms.

3. Quiz Description

The Quiz is a short-form assessment designed to give you an “Energy Score” based on your responses. It is provided for educational and informational purposes only and does not constitute medical, nutritional, fitness, or psychological advice. Always consult a qualified professional for advice tailored to you.

4. Booking a Call

After completing the Quiz you may be invited to book a call with us. Any booking and subsequent engagement are subject to separate agreements and/or communications. We reserve the right to refuse service or cancel a call at our discretion.

5. Use of Content

All content on the Site including text, graphics, logos, information, and other materials (“Content”) is the property of Active30, LLC or its licensors and is protected by copyright, trademark and other laws. You may not reproduce, distribute, modify, or create derivative works of the Content without our prior written permission.

6. User Conduct

You agree not to:

a. Use the Site or Quiz for any unlawful purpose or in violation of these Terms;

b. Interfere with or disrupt the Site, servers or networks connected to the Site;

c. Submit false or misleading information via the Quiz;

d. Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.

7. Disclaimers and Limitations of Liability

a. The Quiz and Site are provided “as-is” and “as available”, without warranty of any kind, express or implied—including warranties of merchantability, fitness for a particular purpose, or non-infringement.

b. To the fullest extent permitted by law, Active30 shall not be liable for any indirect,

incidental, consequential, special or punitive damages, or any loss of profits or revenues,

whether incurred directly or indirectly, arising out of or in connection with your access to

or use of the Quiz, Site or your reliance on any information obtained through the Quiz.

c. Our maximum aggregate liability to you for any claim arising under these Terms shall

not exceed the amount you paid (if any) for use of the Quiz (which is likely zero).

8. Intellectual Property Rights

You acknowledge that all intellectual property rights in the Content and Site remain with Active30 or its licensors. Nothing in these Terms grants you any right, title, or interest in the Content or Site, except for the limited rights to use the Quiz in accordance with these Terms.

9. Modifications

We reserve the right to modify or suspend, temporarily or permanently, the Quiz or Site (or any part thereof) with or without notice. We may revise these Terms at any time by posting updated Terms on the Site. The “Last updated” date at the top of these Terms will reflect when changes were made. Your continued use of the Quiz following posting of any changes constitutes your acceptance of those modifications.

10. Termination

We may terminate or suspend your access to the Quiz and/or Site immediately, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the Quiz will cease.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state of Texas in the Travis County without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or your use of the Quiz shall be subject to the exclusive jurisdiction of the courts of Travis County, Texas.
